Purchase & Participation Terms

Effective Date: 07 February 2026


1. Acceptance of Terms

By purchasing or participating in any program, session, membership, or service provided by Viper

Baseball Academy (“we”, “us”, “our”), you (“the Customer”, “Parent/Guardian”, or “Participant”)

agree to be legally bound by these Purchase & Participation Terms.

Where the Participant is under 18 years of age, the Parent or Legal Guardian accepts these terms

on behalf of the Participant.


2. Services Provided

Viper Baseball Academy provides baseball training and development services including structured

programs, clinics, camps, private coaching, memberships, events, and merchandise.

All program details, pricing, inclusions, and schedules are communicated at the time of purchase.

We reserve the right to make reasonable changes to programs, venues, schedules, or coaching

personnel.


3. Fees, Payments & Subscriptions

All fees are payable in advance unless otherwise agreed in writing.

Payments are processed securely via our nominated payment processor using accepted payment

methods.


Subscription cancellations or changes require a minimum notice period prior to the next billing cycle.

Fees already paid are non-refundable.


4. Attendance & Missed Sessions

Participants are responsible for attending scheduled sessions.

Missed sessions are not eligible for refunds or automatic make-up sessions, including absences due

to illness, injury, holidays, school commitments, or personal reasons.

Any make-up sessions or credits may be offered solely at the discretion of Viper Baseball Academy.


5. Refunds & Cancellations

Once a program, term, or training block has commenced, all fees are non-refundable.

Refunds or credits may be considered in exceptional circumstances at our discretion.

Nothing in these terms excludes or limits rights available under Australian Consumer Law.


6. Weather, Facilities & Scheduling

Baseball activities may be impacted by weather, field conditions, or facility availability.

Sessions may be cancelled, rescheduled, relocated, or modified where required for safety or

operational reasons.


Weather-related cancellations do not automatically entitle Participants to refunds.


7. Assumption of Risk & Medical Fitness

Participation in baseball training involves inherent physical risks.

Participation is voluntary and undertaken at the Participant’s own risk.

You confirm the Participant is physically and medically fit to participate and has no condition that

would place them at unreasonable risk.


8. Behaviour, Conduct & Discipline

Participants and Parents/Guardians must behave respectfully toward coaches, staff, other athletes,

and facilities.


Viper Baseball Academy reserves the right to suspend or terminate participation without refund

where behaviour compromises safety, welfare, or program integrity.


9. Photography, Video & Media Consent

By participating in Viper Baseball Academy programs, you grant consent for photographs and video

recordings to be used for promotional, educational, and marketing purposes.


Written notice must be provided prior to participation if consent is withheld.


10. Governing Law

These terms are governed by and construed in accordance with the laws of South Australia,

Australia.
